Terms of Service for Spikey Bot

Welcome to Spikey! These Terms of Service (“Terms”) govern your use of the Spikey Discord bot and its related features (the "Service"). By inviting or using the Service, you agree to be bound by these Terms and to comply with the Discord Terms of Service and Discord Community Guidelines.

1. Eligibility and License

You must be at least 13 years old (or the minimum age for Discord use in your country) to use the Service. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, revocable license to use the Service for personal entertainment.

2. Acceptable Use Policy

You agree not to misuse the Service. This includes, but is not limited to, the following:

• Engaging in any illegal activity or violating the rights of others.
• Spamming, harassing, or threatening other users or developers.
• Using unauthorized automated means (scripts, userbots, etc.) to interact with the Service.
• Attempting to gain unauthorized access, interfere with the Service's operation, or place an unreasonable load on its infrastructure.
• Attempting to reverse engineer any part of the Service.
• Exploiting bugs or glitches for personal gain. Please report them to us responsibly.
• Participating in "real money trading" (RMT), which includes selling or trading virtual items or currency for any real-world value.

Violation of this policy may result in the immediate suspension or termination of your access to the Service at our sole discretion.

3. Virtual Items, Currency, and Premium Features

The Service includes virtual currencies ("coins" and "spikes"), items, or optional premium features ("Premium Features"). You acknowledge the following:

• Virtual currencies and items are licensed features of the Service. They have no real-world monetary value and cannot be redeemed or sold.
• We reserve the absolute right to manage, modify, or eliminate virtual items and currency at our discretion, without liability to you.
• All purchases related to the Service are final and non-refundable, except where required by law or at our sole discretion. Contact support for billing inquiries
• Payments for Premium Features may be processed by third parties (e.g., Patreon), and are subject to their respective terms and policies.

4. User Data and Intellectual Property

Our collection and use of your data are governed by our Privacy Policy, which is incorporated into these Terms. The Service and all its materials, including code, graphics, and data ("Materials"), are the property of the Spikey developers and are protected by intellectual property laws. We reserve all rights not expressly granted in these Terms.

5. Service Availability and Termination

The Service is provided on an "as is" and "as available" basis. We do not guarantee that it will always be secure, uninterrupted, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time.

We may terminate or suspend your access for any reason, particularly for a breach of these Terms, without prior notice.

6. Disclaimer of Warranties and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. THE SPIKEY DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE.

7. Changes to Terms

We reserve the right to modify these Terms at any time. If a change is material, we will provide reasonable notice, such as an announcement in our official Discord server. Your continued use of the Service after changes become effective constitutes your agreement to the revised terms.
